Welcome to Listed Academy. By accessing our website, enrolling in our programs, participating in our community, or using any of our services, you agree to comply with and be bound by the following Terms of Service.

1. Acceptance of Terms

By accessing or using Listed Academy’s website, programs, educational content, coaching services, memberships, events, community platforms, or related services, you acknowledge that you have read, understood, and agreed to these Terms of Service.

If you do not agree to these Terms, you must not access or use our services.

2. Educational Purpose Only

Listed Academy provides educational, mentoring, coaching, and training services designed to assist individuals in developing skills within the real estate industry.

We do not provide financial, legal, employment, business, or investment advice.

Any information, strategies, frameworks, scripts, or guidance provided through our services are for educational purposes only and should not be relied upon as guarantees of specific results.

3. No Guaranteed Results

While Listed Academy aims to provide high-quality education, mentorship, and practical training, individual results will vary significantly depending on factors including:

• personal effort;

• consistency;

• implementation;

• market conditions;

• communication skills;

• experience;

• local competition; and

• individual circumstances outside of our control.

Listed Academy does not guarantee:

• listings;

• income;

• commissions;

• employment;

• career progression;

• business growth; or

• financial success.

Any testimonials, case studies, marketing examples, or success stories displayed by Listed Academy are examples only and should not be interpreted as typical or guaranteed outcomes.

4. 120-Day Listing Guarantee

From time to time, Listed Academy may offer promotional guarantees, including a “120-Day Listing Guarantee.”

​

Eligibility for any refund, reimbursement, account credit, or promotional outcome under such guarantees is conditional upon participants:

• fully complying with all program requirements;

• actively participating in the program;

• completing required modules, accountability activities, implementation tasks, and participation expectations;

• acting in good faith throughout the program; and

• complying with all conduct and community standards established by Listed Academy.

 

All refund or guarantee assessments are conducted reasonably and in good faith by Listed Academy based on a participant’s engagement, implementation, participation, and adherence to program requirements.

Listed Academy reserves the right to decline refund requests where participation requirements, conduct expectations, implementation obligations, or program conditions have not been reasonably satisfied.

​

Listed Academy further reserves the right to modify, suspend, withdraw, or amend any promotional offer or guarantee at any time without prior notice.

​

Nothing within our website, advertising, marketing materials, coaching, or programs constitutes a guarantee of listings, financial success, or career outcomes.

5. Payments & Subscriptions

By purchasing or enrolling in a Listed Academy program, membership, or service, you agree to:

• pay all applicable fees;

• provide accurate billing information; and

• maintain valid payment methods where applicable.

Unless otherwise stated in writing, all payments are non-refundable except where required under Australian Consumer Law or expressly provided under an eligible promotional guarantee.

If your program includes recurring billing or subscription payments, you authorise Listed Academy to process recurring charges using your nominated payment method until cancelled in accordance with your membership terms.

​

Failure to make payments may result in suspension or termination of access to services.

​

6. Intellectual Property

All content provided by Listed Academy, including but not limited to:

• training materials;

• videos;

• modules;

• templates;

• frameworks;

• scripts;

• branding;

• graphics;

• downloads;

• community content;

• presentations; and

• educational resources,

remain the intellectual property of Listed Academy unless otherwise stated.

You may not reproduce, distribute, share, sell, copy, republish, upload, record, or commercially exploit any Listed Academy content without prior written consent.

Unauthorised sharing of member content, login credentials, training materials, or intellectual property may result in immediate termination of access without refund and may result in legal action.

7. Community Conduct

Participants are expected to behave respectfully and professionally within all Listed Academy communities, coaching environments, events, online platforms, and communications.

Listed Academy reserves the right to suspend or remove any participant, member, or user who:

• behaves in a disruptive, abusive, threatening, discriminatory, defamatory, or inappropriate manner;

• breaches confidentiality;

• attempts to solicit members outside the platform;

• shares copyrighted or confidential material without authorisation;

• damages the reputation of Listed Academy; or

• breaches these Terms of Service.

Termination due to misconduct may occur without refund.

8. Account Access

Access to Listed Academy platforms and programs is intended solely for the enrolled participant.

You must not share login credentials, distribute content externally, or permit third parties to access your membership or purchased materials.

Listed Academy reserves the right to monitor account activity and suspend access where unauthorised usage is suspected.

9. Limitation of Liability

To the maximum extent permitted by law, Listed Academy, its directors, employees, contractors, affiliates, and representatives exclude all liability for any direct, indirect, incidental, consequential, special, or economic loss arising from:

• use of our services;

• reliance on educational content;

• inability to access services;

• business interruption;

• loss of income;

• loss of opportunity;

• career outcomes;

• reputational damage; or

• third-party actions.

Where liability cannot be excluded under applicable law, liability is limited to the amount paid by the participant for the relevant service.

10. Third-Party Platforms & Services

Listed Academy may utilise third-party software, payment processors, community platforms, video hosting services, or communication tools.

We are not responsible for outages, interruptions, data breaches, errors, or functionality issues caused by third-party providers.

11. Privacy

Your use of Listed Academy services is also governed by our Privacy Policy.

12. Changes to Terms

Listed Academy reserves the right to update, modify, or replace these Terms of Service at any time.

Updated Terms become effective immediately upon publication on our website.

Continued use of our services constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes arising in connection with these Terms or the use of Listed Academy services will be subject to the exclusive jurisdiction of the courts of New South Wales.
